TERMS:

- This is a two round auction process. All persons wishing to bid must turn in a sealed bid first. Those bidders will have an opportunity to increase their bid at the live auction on Wednesday, Sept. 26th. If there are no advances at the live auction, the highest sealed bid(s) will stand as the high bid.

- All sealed bids must be mailed or hand delivered on or before Tuesday, September 25th at 5:00 p.m. to Kurt Kiefer Auctioneers, 23 Broadway, 2nd Floor, Fargo, ND 58102. Phone is (701) 365-1000. Sealed bids must include the bidder form AND $1,000 deposit per parcel ($2,000 if bidding on both parcels). The deposits will be returned to unsucessful bidding immediately following the auction.

- The oral portion of the auction will be held at 11:00 am SHARP! on Wednesday, September 26th at the offices of the Auctioneers at 23 Broadway, Fargo, ND. The auction will be brief, so be on time.

- Closing will be as soon as buyer(s) is able but not later than October 31, 2007. The current lease runs thru Dec. 31, 2007 and will be assigned to the new buyer. The current year lease payment will be kept the sellers. The 2006 taxes due in 2007 will be paid by the seller.
